2) Acceptance of Terms
By accessing or using our website, the Wreet desktop application, or any related online services (collectively, the “Services”), you confirm that:
- you have read, understood, and agree to be bound by these Terms;
- you also agree to our Privacy Policy and Refund Policy;
- if you are using the Services on behalf of an entity, you have authority to bind that entity to these Terms.
If you do not agree, you must not use the Services.
3) License & Permitted Use
Subject to your compliance with these Terms and any applicable order or subscription agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Wreet:
- solely for your own internal professional/business purposes;
- solely via the official Wreet client and interfaces we provide;
- on no more than two computers per subscription, both owned or controlled by the same customer or registered business and properly registered to that subscription.
Wreet is licensed, not sold. All rights not expressly granted are reserved by us. We may use technical measures (including hardware-bound identifiers and device keys) to verify that your installation is genuine, to enforce device limits, and to prevent tampering or unauthorized use.
The two authorized computers must not be shared with another person, workshop, or company. They should normally be used from the same public IP address or the same approximate geographic area. Exact IP matching is not required because public IP addresses can change. Regular use from unrelated distant locations or countries (for example, one device in the United Kingdom and another in Spain) may be treated as license sharing. Normal temporary travel is permitted where you can reasonably verify legitimate use. We may request verification, suspend the second activation, or restrict access where usage appears suspicious.
- Intended Environment — Wreet is intended for motorsport, research, or off-road vehicles. You are responsible for ensuring compliance with your local laws. Do not use the software on vehicles operated on public roads where such modifications are prohibited.
-
Prohibited — without our prior written consent you may not:
- resell, redistribute, or commercialize Wreet outputs or access (e.g. “dumping” solutions into your own database/service);
- share, rent, resell, sublicense, transfer, or otherwise provide an account, license, key, or activation to another person, workshop, business, or company;
- allow another business to use your account or either of your authorized computers;
- bypass hardware locks, license checks, security controls, rate limits, subscriptions, or feature restrictions;
- spoof, falsify, or conceal hardware identifiers, public IP information, or network-based location signals;
- use any automated system to access or query Wreet beyond documented interfaces;
- reverse engineer, decompile, decrypt, disassemble, copy, or reproduce Wreet or any licensing system, except where prohibited by mandatory applicable law.
4) Intended Use & Compliance
Strictly prohibited and unlawful uses include (non-exhaustive):
- odometer rollback/manipulation or any mileage fraud;
- preparing or modifying vehicles for theft or other criminal activity;
- tampering with emissions, safety, or regulatory controls where prohibited;
- any other use contrary to applicable laws or regulations.
Customer Responsibility: Before using Wreet or applying an output, you must:
- confirm that you are authorized to work on the vehicle or electronic module and obtain the vehicle owner’s permission where required;
- check whether the requested modification is legal in the country where the vehicle or module will be used;
- comply with emissions, road-use, inspection, consumer-protection, safety, and all other applicable laws;
- back up all original files, coding, and calibration data; and
- check compatibility and carefully test every modified file before use.
Benc Motorsport provides software tools, while you control the jobs, inputs, outputs, and manner of use. We do not verify ownership of every vehicle, authorization for every job, or whether a modification is lawful in your country. We are not responsible for harm arising from unlawful, improper, incompatible, or negligent use.
5) Abuse, Fair Use & Enforcement
To protect our Services, our intellectual property, and other users, we actively detect and respond to abuse. Abuse includes, without limitation:
- using Wreet outputs for resale or operating a competing solution database using Wreet-derived data;
- systematically submitting files from the same or similar ECUs to reconstruct or extract our proprietary logic or database;
- account or key sharing, use by another business, use on more than two unauthorized devices, or regular use from unrelated distant locations;
- bypassing or attempting to bypass license checks, hardware/device binding, security, subscriptions, rate limits, or feature restrictions;
- hardware or location spoofing, or reverse engineering or tampering with Wreet, except where prohibited by mandatory applicable law;
- automated or bulk access not authorized by us;
- using Wreet for prohibited or illegal vehicle modifications (including odometer manipulation, facilitating theft, or data falsification);
- any conduct that harms, overloads, or interferes with the Services or our infrastructure.
Technical Enforcement Features: You acknowledge and agree that we may use technical measures to detect and respond to abuse, including:
- hardware-bound identifiers and device keys to authenticate the client and enforce license limits;
- integrity checks to verify that the Wreet client and its environment have not been tampered with;
- login and activation history, public IP address, approximate network-based location, hardware identifiers, license-validation events, and normal usage patterns, as described in our Privacy Policy;
- local detection of certain remote-control or screen-sharing tools and debuggers/instrumentation, which may cause the app to log out or close to protect users and the service.
Enforcement: Where there is reasonable evidence of license sharing, unrelated distant-location use, more than two unauthorized devices, hardware or location spoofing, fraud, unlawful use, reverse engineering, or an attempt to bypass security or licensing, we may:
- temporarily suspend or terminate your account, license, or access;
- suspend the second activation or block or de-register specific devices or keys;
- refuse future sales or activations;
- take technical and legal measures to protect our rights and other users.
Where appropriate, we will allow you to provide reasonable verification of ownership, business identity, authorized devices, or legitimate temporary travel. Any refund remains governed by the Refund Policy and mandatory applicable law.
6) Digital Agreement & Contract Signing
Before obtaining full access to Wreet, you may be required to sign a digital agreement (Service Subscription Agreement or similar). This agreement incorporates these Terms, our Privacy Policy, and key commercial and licensing conditions. Access to Wreet may be conditional upon successful completion of this digital agreement.
We store the signed agreement, including your signature and identifying details, as described in our Privacy Policy, for proof of consent, licensing, and legal compliance.
7) Payments, Activation & Refunds
- Payments — processed by approved third-party providers (e.g. PayPal). We do not store full payment card data; your payment data is handled under the provider’s terms and privacy policy.
- Digital Access — access begins when we issue working credentials or enable the account, license, download, file-processing service, or paid feature.
- Activation — a license is activated or used when a computer is registered, a successful license-validation event occurs, you log in and use a paid feature, download the software or paid content, or submit a file for processing.
- Refunds — eligibility is governed by our Refund Policy and mandatory consumer laws. Activation or use may restrict eligibility, but mandatory consumer rights remain unaffected.
- Anti-Fraud — we may verify order ownership, device/activation status, and abuse indicators before granting refunds or account changes.
8) Privacy & Telemetry
We process personal and technical data to operate, secure, and improve Wreet, validate licenses, and prevent abuse. Key points (summary only — see the Privacy Policy for full details):
- Licensing records may include login dates and times, activation and deactivation events, hardware identifiers, public IP addresses, approximate network-based location, and license-validation events.
- Operational records may include feature usage, API requests, upload and download history, file-processing history, and security and error logs.
- These records may be used for license verification, enforcement of the two-computer limit, detecting account sharing, security and fraud prevention, support and troubleshooting, and investigating disputed usage.
- Approximate location is inferred from network information; we do not claim to collect GPS or precise device location.
All processing is carried out in accordance with our Privacy Policy and applicable data protection laws.
9) Intellectual Property
Wreet, including all software, code, models, algorithms, solution logic, documentation, designs, and branding, is owned by BENC ELEKTRONIK (trading as Benc Motorsport) or its licensors and is protected by copyright, trade secret, and other intellectual property laws.
Except as expressly permitted in these Terms or by mandatory law, you may not: copy, modify, adapt, translate, create derivative works from, publicly display, distribute, or otherwise exploit any part of Wreet or its outputs, nor remove or alter proprietary notices.
10) User Contributions
If we provide interactive areas (such as forums, comments, or profiles), you are solely responsible for content you submit. You must not upload unlawful, infringing, or harmful content. We may remove content that violates these Terms or applicable law.
11) Disclaimers
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Services will be uninterrupted, error-free, or compatible with every ECU or use case.
We do not guarantee that any output, file, or configuration generated using Wreet will be safe, lawful, road-legal, or suitable for your specific vehicle or jurisdiction. You are solely responsible for checking and validating any changes you apply.
Automotive electronic work can cause failed ECU or module programming, corrupted files, a non-starting vehicle, loss of coding or calibration data, workshop downtime, towing, labor or diagnostic costs, customer claims, and emissions or inspection failure, particularly where a file is incompatible or incorrectly applied. You must keep verified backups, use suitable and correctly configured tools, maintain stable vehicle voltage during programming, verify compatibility, and test results safely before release or road use.
12) Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, punitive, or similar damages, nor for any loss of profits, revenue, data, goodwill, or business interruption, arising out of or in connection with your use of or inability to use the Services, including workshop downtime, towing, labor, diagnostics, customer claims, corrupted or lost files, failed programming, non-starting vehicles, or emissions or inspection failure, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or relating to the Services or these Terms shall be limited to the amounts you paid us for the relevant Wreet license or subscription during the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under mandatory applicable law.
Without limiting the above, we have no liability for any damage, loss, or unlawful act arising from: odometer manipulation, facilitating theft, regulatory non-compliance, or any other illegal or improper use of Wreet or its outputs.
13) Indemnification
You agree to indemnify, defend, and hold harmless BENC ELEKTRONIK (trading as Benc Motorsport), its officers, directors, employees, agents, and licensors from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- your use or misuse of the Services or outputs;
- your breach of these Terms or applicable law;
- your violation of any third-party right;
- your performance of illegal or prohibited vehicle modifications, including but not limited to mileage fraud, or facilitating theft.
14) Changes to These Terms
We may update these Terms from time to time. The “Effective date” above shows the latest version. Where required or appropriate, we will notify you of material changes (for example via the website, within the Wreet app, or by email). Continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.
15) Governing Law
These Terms are governed by the laws of Croatia (EU), without regard to conflict of laws rules. Mandatory consumer protection laws of your country of residence (if applicable) remain unaffected.
16) Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
17) Survival
Sections relating to Intended Use & Compliance, Abuse & Enforcement, Payments, Privacy & Telemetry, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and any other provisions which by their nature should survive, shall survive termination or expiration of these Terms.
